On 16 November 2021 the Queensland Government announced the Department of Energy and Public Works had commissioned an independent review of the Queensland Building and Construction Commission (QBCC) governance arrangements.

The independent review aims to ensure that the governance of the QBCC is contemporary, fit for purpose and reflects best practice.

  • Commissioner responsibilities

    The QBCC Commissioner's responsiblities are defined in the Queensland Building and Construction Commission Act 1991.

    Commissioner responsibilities

    1. the overall management of the organisational unit under the control of the commissioner;
    2. administration of the licensing system established by this Act;
    3. administration of a system of inspection;
    4. issuing directions for rectification of building work under this Act;
    5. monitoring, investigating and enforcing compliance with part 6AA, including giving directions for remedial action for contraventions of part 6AA, division 2, subdivision 2;
    6. taking disciplinary and other proceedings under this Act;
    7. assessing and approving payment of insurance claims;
    8. undertaking strategic planning;
    9. issuing warnings to the public or any section of the public;
    10. providing and promoting consumer education;
    11. publishing information about building products, including, for example—
      1. the uses for which particular building products are not suitable; and
      2. how to use particular building products to ensure their use is safe and complies with relevant legislation;
    12. providing an advisory service to consumers about—
      1. their statutory rights and obligations; and
      2. insurance claims that may arise about building work; and
      3. the commission’s role, functions and operating procedures; and
      4. any incidental matters;
    13. providing courses of instruction for—
      1. persons seeking to obtain licences; and
      2. licensees; and
      3. persons proposing to carry out building work as owner-builders; and
      4. other persons seeking to acquire knowledge or expertise in subjects related to the building industry;
    14. performing a function given to the commissioner under an Act.
  • Board functions

    The QBBC Board functions are defined in the Queensland Building and Construction Commission Act 1991.

    Board functions

    1. deciding the strategies and the operational, administrative and financial policies to be followed by the commission;
    2. ensuring the commission performs its functions and exercises its powers in a proper, effective and efficient way;
    3. providing guidance and leadership to the commissioner;
    4. providing guidance and leadership to the Service Trades Council, other than in relation to its function of conferring on national policy development and implementation for the plumbing and drainage trade under the Plumbing and Drainage Act 2018;
    5. advising the Minister on issues affecting—
      1. the building industry; and
      2. consumers; and
      3. the administration of this Act; and
      4. the administration of the commission;
    6. advising the Minister about unfair or unconscionable trading practices affecting security of payments to contractors and subcontractors;
    7. consulting the building industry and its consumers and advancing their interests, consistently with the objects of this Act.
